These Terms & Conditions (“Terms”) govern your use of the website located at https://www.w-forum.com/ (the “Service”), operated by Women’s Support Forum, a company registered in the Republic of Latvia (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be legally bound by these Terms.

If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old to use this Service.

By using the Service, you represent and warrant that:

You have the legal capacity to enter into a binding agreement
You are not prohibited from using the Service under applicable law

We reserve the right to suspend or terminate accounts suspected of violating this section.

2. Nature of the service

Women’s Support Forum is an online subscription-based discussion platform intended for peer-to-peer communication.

The Company:

Does not provide medical advice
Does not provide psychological advice
Does not provide legal advice
Does not provide financial advice

All content is for informational and peer-support purposes only.

You acknowledge that you use the Service at your own risk.

3. User accounts

To access certain features, you must create an account.

You agree to:

Provide accurate and current information
Maintain confidentiality of login credentials
Accept responsibility for all activity under your account

We may suspend or terminate accounts at our sole discretion for violations of these Terms.

4. Subscriptions & payments

Certain features require a paid subscription.

All prices are listed in United States Dollars (USD).
Payments are billed in advance.
Subscriptions automatically renew unless canceled prior to the renewal date.
You are responsible for managing or canceling your subscription.

Refund Policy:

Payments are non-refundable except where required by applicable consumer protection laws.

Chargebacks or fraudulent payment disputes may result in immediate account termination.

5. User-generated content

The Service contains content submitted by users.

You retain ownership of content you post. However, by posting content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, and promote such content for purposes of operating the platform.

You agree not to post:

Harassment or hate speech
Threats or incitement to violence
Defamatory content
False or misleading statements
Explicit sexual content
Illegal content
Professional advice presented as authoritative

We reserve the right to remove content at our sole discretion.

6. Section 230 notice (for U.S. users)

Women’s Support Forum is an interactive computer service provider under Section 230 of the U.S. Communications Decency Act.

We are not the publisher or speaker of user-generated content.

We are not liable for content posted by users.

7. Assumption of risk

You acknowledge that:

Discussions may involve sensitive topics
Advice shared by users may be inaccurate or inappropriate
You are solely responsible for any decisions made based on platform content

You expressly assume all risks associated with use of the Service.

8. Community rules

Users must:

Treat others respectfully
Not harass or exploit other members
Not solicit money or personal data
Not attempt to manipulate or scam users

Violations may result in immediate account termination.

9. Privacy & Data protection

We process personal data in accordance with:

General Data Protection Regulation (GDPR)
Applicable Latvian law

10. Intellectual property

All branding, platform design, logos, and proprietary materials belong to Women’s Support Forum.

11. No warranties

The Service is provided “AS IS” and “AS AVAILABLE.”

We make no warranties regarding:

Accuracy of user content
Availability or uninterrupted operation
Compatibility with devices
Fitness for a particular purpose

12. Limitation of liability

To the maximum extent permitted by law:

The Company’s total liability shall not exceed the greater of:

$100 USD, or
The amount paid by you in the three (3) months preceding the claim.

We shall not be liable for:

Emotional distress
User disputes
Business losses
Data loss beyond reasonable security measures
Indirect or consequential damages

Some jurisdictions do not allow certain limitations; in such cases, liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Women’s Support Forum from any claims arising out of:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights

14. Governing law (EU + international structure)

These Terms are governed by the laws of the Republic of Latvia and applicable European Union law.

For users residing outside the European Union, you agree that any disputes shall be resolved under Latvian law unless mandatory consumer protection laws in your jurisdiction provide otherwise.

15. Dispute resolution for U.S. users

If you are a resident of the United States:

Any dispute shall be resolved through binding arbitration on an individual basis.

You waive the right to:

Participate in class actions
Participate in class arbitration
Trial by jury

Arbitration shall be conducted under recognized arbitration rules and may be conducted remotely.

This section does not apply where prohibited by law.

16. International users

The Service is operated from the Republic of Latvia.

Users accessing the Service from outside the European Union do so at their own initiative and are responsible for compliance with local laws.

Nothing in these Terms limits mandatory consumer rights applicable in your country of residence.

17. Termination

We may suspend or terminate access at our sole discretion.

Termination does not entitle you to a refund unless required by law.

18. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force.

19. Changes to terms

We may update these Terms from time to time.

Material changes will be communicated via the website.

Continued use of the Service constitutes acceptance of updated Terms.

Refund / Cancellation Policy

1. Subscription Cancellation

Users may cancel their subscription at any time through their account settings.
Upon cancellation, the subscription will remain active until the end of the current billing period.
No further recurring charges will be applied after cancellation.

2. Refunds

All payments are non-refundable, except where required by law (e.g., EU 14-day cooling-off period for consumers).
Requests for refunds must be submitted in writing to womenssforum@gmail.com.
If a legally required refund is applicable, it will be processed using the same payment method used for the purchase within 14 business days.

3. Changes to Subscription Plans

Women's Support Forum reserves the right to change subscription prices or features at any time.
Users will be notified of significant changes via email.
Users who do not agree with the changes may cancel their subscription following the cancellation process above.

4. No Refunds for Partial Use

No refunds will be provided for partial use of the subscription period, inactive accounts, or voluntary account deletion.

5. Special Legal Rights

This Policy does not affect your statutory rights under applicable consumer protection laws.
EU users are entitled to a 14-day cooling-off period for online services, starting from the subscription date, unless they have explicitly agreed to immediate service delivery.

DISCLAIMER, LIMITATION OF LIABILITY & USER RESPONSIBILITY

1. No Professional Advice

The content available on Women’s Support Forum, including posts, comments, discussions, articles, messages, and any other materials, is provided for informational and peer-support purposes only.

Women’s Support Forum does not provide medical, psychological, therapeutic, legal, financial, or other professional advice.

Nothing on the Platform should be interpreted as professional advice of any kind. You acknowledge that any reliance on information provided through the Platform is solely at your own risk.

If you require professional assistance, you should seek a qualified licensed professional in your jurisdiction.

2. User-Generated Content

The Platform includes content created and posted by users.

Women’s Support Forum:

Does not pre-screen all user content
Does not guarantee accuracy, completeness, or reliability of user posts
Is not responsible for opinions, advice, statements, or representations made by users

Users are solely responsible for the content they publish and for any consequences arising from their posts.

We reserve the right (but not the obligation) to remove content that violates our Terms.

3. Assumption of Risk

By using the Platform, you acknowledge that:

Discussions may include sensitive or emotional topics
Content may be inaccurate, incomplete, or subjective
You are solely responsible for your decisions and actions

You assume full responsibility for any actions taken based on content found on the Platform.

4. No Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by applicable law, Women’s Support Forum disclaims all warranties, express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of content
Uninterrupted or error-free operation

We do not guarantee that the Service will meet your expectations or be free from technical issues.

5. Limitation of Liability

To the fullest extent permitted by law:

Women’s Support Forum, its owners, directors, employees, affiliates, and service providers shall not be liable for:

Any indirect, incidental, consequential, special, or punitive damages
Emotional distress
Loss of data
Loss of profits
Personal injury
Any damages arising from user-generated content
Any reliance on information provided through the Platform

In any event, our total aggregate liability shall not exceed the total amount paid by you to Women’s Support Forum during the twelve (12) months preceding the event giving rise to the claim.

If you have not made any payments, our total liability shall not exceed one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations of liability. In such cases, liability shall be limited to the maximum extent permitted by law.

6. Indemnification

You agree to defend, indemnify, and hold harmless Women’s Support Forum, its owners, affiliates, employees, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of the Platform
Your violation of these Terms
Your posted content
Your violation of any third-party rights
Any actions taken based on content you accessed through the Platform

7. Platform Role

Women’s Support Forum operates as an online platform for user interaction and peer discussion.

We are not the publisher of user-generated content and do not assume editorial responsibility for user statements.

DISPUTE RESOLUTION, BINDING ARBITRATION & CLASS ACTION WAIVER

1. Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact Women’s Support Forum at [ievieto e-pastu] and attempt to resolve the dispute informally for at least thirty (30) days.

Both parties agree to act in good faith to resolve the matter.

2. Binding Arbitration (For Users Located Outside the European Union)

If you are located outside the European Union, including in the United States, you agree that any dispute, claim, or controversy arising out of or relating to:

These Terms
The Privacy Policy
The Service
Your use of the Platform

shall be resolved exclusively through final and binding arbitration, rather than in court.

Arbitration shall be conducted:

In English
By a single neutral arbitrator
Under internationally recognized arbitration rules
On an individual basis only

The arbitration may be conducted remotely (including via video conference), unless otherwise required by law.

Judgment on the arbitral award may be entered in any court having jurisdiction.

3. Waiver of Jury Trial

To the fullest extent permitted by law, you waive any right to a trial by jury in any dispute arising out of or relating to the Service.

4. Class Action Waiver

You agree that any arbitration or proceeding shall be conducted solely on an individual basis.

You waive the right to:

Participate in a class action
Act as a class representative
Join claims with other users
Bring or participate in any collective or representative proceeding

The arbitrator shall not have authority to consolidate claims or conduct any class or representative proceeding.

If this Class Action Waiver is found unenforceable under applicable law, then this arbitration agreement shall be deemed null and void only with respect to that specific claim.

5. Small Claims Exception

Nothing in this section prevents either party from bringing an individual claim in a small claims court, if the claim qualifies under applicable law.

6. European Union Users

If you are a consumer residing in the European Union:

Nothing in this section limits your mandatory consumer protection rights under EU law.
You retain the right to bring claims before the competent courts of your country of residence, where required by applicable law.

This arbitration clause shall not apply where prohibited by EU consumer protection legislation.

7. Governing Law

These Terms shall be governed by the laws of Latvia, without regard to conflict of law principles.

For users outside the European Union, arbitration shall apply as set forth above.
